📄 Agreement to Terms

These Terms of Service ("Terms") govern your use of Elixio — the app, website (elixio.fit), and all related services (collectively, the "Service") provided by Elixio ("we", "us", "our").

By creating an account or using the Service you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.

✅ Eligibility

• You must be at least 13 years old to use Elixio.
• If you are between 13 and 18, a parent or legal guardian must review and accept these Terms on your behalf.
• By using the Service you represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms.

🆓 Free Service

Elixio is provided completely free of charge. There are no premium tiers, paywalls, or subscription fees. All features — AI meal plans, smartwatch sync, exercise library, exports — are included at no cost.

🏥 Not Medical Advice

• Calorie targets, macro recommendations, and exercise suggestions are estimates based on general population formulas (Mifflin-St Jeor BMR, ACOG exercise guidelines, WHO/NHS nutrition references). They are not personalised medical prescriptions.
• Pregnancy-related features are informational only. Always consult your obstetrician, midwife, or healthcare provider before changing your diet or exercise routine during pregnancy.
• If you have a medical condition, eating disorder, injury, or other health concern, consult a qualified healthcare professional before using Elixio.
• Do not use Elixio as a substitute for professional medical advice, diagnosis, or treatment.

👤 Your Account

• You are responsible for maintaining the security of your account and for all activity that occurs under it.
• Notify us immediately at elixio@elixio.fit if you suspect unauthorised access.
• You may not create accounts for other people without their explicit consent, or use the Service on behalf of a third party without authorisation.
• One person, one account — you may not transfer your account to another person.

🚫 Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use automated scripts, bots, or scrapers to access the Service
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service to transmit malware, spam, or any content that is unlawful, harmful, or deceptive
• Resell, sublicense, or commercially exploit any part of the Service without our written consent
• Impersonate Elixio or any other person or entity

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

🗃️ Your Data & Content

• Your data belongs to you. Food logs, workout records, body metrics, and exports you create in Elixio are yours.
• By using the Service you grant us a limited, non-exclusive licence to process your data solely to operate and improve Elixio (e.g., to sync your logs, generate AI meal plans, and display analytics). We do not sell your data.
• You can export all your data in PDF or CSV format at any time from the Reports screen.
• You can request full account and data deletion at any time — see our Privacy Policy for details.

🤖 AI-Generated Content

Elixio's AI meal plan feature generates nutritional suggestions based on your profile. Please be aware:

• AI-generated meal plans are suggestions, not prescriptions. Review them before following any recommendation.
• Calorie and macro values for AI-generated meals are estimates and may not be perfectly accurate for all ingredient brands and preparation methods.
• We make no warranty that AI meal recommendations are appropriate for your specific medical or dietary needs.

📦 Third-Party Services

The Service integrates with third-party platforms including Apple HealthKit, Google Health Connect, and Firebase (Google). Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

🛡️ Intellectual Property

• The Elixio name, logo, app design, exercise animations, and website content are owned by Elixio and protected by applicable intellectual property laws.
• The 10M+ food database is aggregated from public and licensed sources. Individual food entries may be user-submitted or third-party sourced.
• You may not reproduce, distribute, or create derivative works from our content without written permission.

⚠️ Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

• We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses.
• Calorie counts, macro calculations, and nutritional data are estimates and may not reflect precise values for every food or preparation method.
• We are not responsible for decisions you make — dietary, medical, or otherwise — based on information from the app.

📉 Limitation of Liability

To the maximum extent permitted by applicable law, Elixio and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which, for the current free Service, is zero).

🔄 Changes to the Service & These Terms

• We may modify or discontinue any part of the Service at any time, with or without notice, though we will endeavour to give reasonable advance notice for significant changes.
• We may update these Terms to reflect changes in our practices, legal requirements, or new features. The updated date at the top of this page reflects when changes were last made.
• Continued use of Elixio after updated Terms are posted constitutes your acceptance of the new Terms.

⚖️ Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration or the courts of the jurisdiction where Elixio operates, as applicable.
